Marriage Celebration and Registration at the Consulate

Requirements:

In case of disabled person:

  • Identity document, filiation information or a document that states their marital status.
  • Two suitable witnesses who must present their identity document or filiation information. There may be more witnesses if requested.
  • In case one or both of the parties have underage children under their custody, they must present a duly protocolized nomination for a Special Guardian to the Consul. In case they are managing the assets of said children, they will also have to present a formal inventory of assets. Both of these procedures will be performed before a Civil Judge. In case they do not have Parental Authority over their underage children they may present the following justifying documents: resolution of a competent authority or affidavit stating that they do not hold said Parental Authority. Art. 20 of the Instructive for the Standardization of the National System of Civil Registration.

Marriage between single Ecuadorian citizens when one or both of them is under age 18

  • Identity document, filiation information or a document that states their marital status.
  • Two suitable witnesses who must present their identity document or filiation information. There may be more witnesses if requested. .
  • Consent of the mother, the father or the person who holds the Parental Authority of the minor, who will sign the Marriage Consent Minute. In case parents are separated, the authorization will be given by the parent who holds custody of the child presenting an affidavit that states said custody. (Art. 307 Civil Code Codification).
  • In case of absence of the parents, the consent may be granted through a power of attorney. If both parents are unable to exert Parental Authority, the consent will be given by the tutor or guardian or whoever exerts custody over the minor and the corresponding nomination or judiciary resolution must be attached. If one of the parents who hold Parental Authority of the minor has deceased, the other one must present the death certificate. If both of them have deceased, the Custody of the minor will be exerted by a tutor nominated by a Court.
  • Updated full birth certificate.
  • In case they have underage children under their custody, they must present a duly protocolized nomination for a Special Guardian to the Consular Agent. In case the child has any assets, they will also have to present the nomination of the person who manages said assets. Both of these procedures will be performed before a Civil Judge.
  • In case they do not have Parental Authority over their underage children they may present the following justifying documents: resolution of a competent authority or affidavit stating that they do not hold said Parental Authority.

Marriage in which one of the intended spouses is a foreign citizen

  • Identity document or original certificate that states their filiation information and their marital status, issued by the Embassy or Consulate of the country of origin if that were the case. In case the document was issued at the country of origin it must be legalized or apostilled and translated if that were the case.
  • If the foreigner citizen is divorced or a widower, they must present the documents that support said marital status, legalized or apostilled and translated if that were the case.
  • Two suitable witnesses who must present their identity document or filiation information. There may be more witnesses if requested.
  • In case the foreigner citizen is under the age of 18, they must abide by the present manual.

Marriage between Ecuadorian citizens when one or both of them are divorced:

  • Identity document, filiation information or a document that states their marital status.
  • Two suitable witnesses who must present their identity document or filiation information. There may be more witnesses if requested.

In case of disabled person:

  • Disability Card issued by a competent institution or its equivalent.

Note: The Constitution of Ecuador only recognizes the marriage between a man and a woman
